I do not get overly hung up on "only congress can declare war" since there have been at LEAST 125 occasions when the President of the United States has employed our Military Forces without authorization from congress.
One of those "occasions" was KOREA. You can call it what ever you want, but you can not convince anyone who fought in it, that it was not a long, hard fought, WAR, in which over 142,000 Americans died.
