I think they're right about the audits but wrong about the capital gains tax. I think that a number of other countries do the same thing if they have a capital gains tax, and probably for the same reason we do: everybody WANTS foreign investors.
Now there IS a risk with foreign investors taking over companies, but that's a different issue, and capital gains tax or the lack thereof isn't the way to control that.
